Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.Definitions
For the purposes of these Terms of Service:- Company (referred to as either “the Company”, “We”, “Us” or “Our” in these Terms) refers to 3Porter, an Indiana-based business entity.
- Service refers to the Website and WordPress Plugin.
- Website refers to 3Porter, accessible from https://www.3porter.ai
- Plugin refers to the 3Porter WordPress plugin software.
- AI Services refers to third-party artificial intelligence services used to generate content.
- Account refers to a unique account created for You to access our Service.
- Member or User refers to the individual or entity that has created an Account and uses our Service.
- Free Trial refers to the limited-time access to our Service with usage restrictions.
- Paid Membership refers to subscription-based access to our Service with expanded usage limits.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.
Acceptance of Terms
By accessing or using our Service, You agree to be bound by these Terms of Service. If You disagree with any part of these Terms, then You may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.Age Requirements
The Service is intended for individuals who are 18 years or older, or who are considered legal adults in their jurisdiction. By using the Service, You represent and warrant that You meet these age requirements.Geographic Availability
The Service is available only in countries and regions of Our choosing, at Our sole discretion. Geographic availability may be changed at any time without notice. Currently, the Service is primarily available to users in North America.Account Registration and Management
Account Creation
To access certain features of the Service, You must create an Account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding Your Account credentials and for all activities that occur under Your Account.Account Transfer
Accounts are non-transferable. You may not transfer, sell, or assign Your Account to any other person or entity.Account Retention
Upon cancellation of Your membership, Your Account will remain active until manually deleted by You or by Us. We do not automatically delete Accounts based on cancellation or inactivity.Membership Types and Usage Limits
Free Trial
Free Trial members are limited to generating 10,000 words and 50 images during the trial period.Paid Membership
Paid Members (both monthly and annual subscriptions) are allocated 1,000,000 words and 150 images per month. Monthly limits reset at the beginning of each calendar month during the active membership period and provided the membership fees are paid on time and in full.Additional Images
Paid Members may purchase additional images as add-ons to their subscription. These additional images do not expire and carry over beyond the monthly allocation. No refund for unused additional images will be issued. Unused additional images will not be available after an Account or Paid Membership is terminated by any means or by either Us or You.Usage Monitoring
We monitor usage to ensure compliance with allocated limits. Attempts to exceed allocated limits through unauthorized means will result in immediate Account termination with no refund issues, either in part or in full.Acceptable Use Policy
Permitted Uses
You may use the Service solely for generating content for WordPress posts in accordance with these Terms.Prohibited Uses
You agree not to use the Service for:- Generating content that is not family-friendly, including but not limited to adult content, violence, or hate speech
- Any illegal activities or purposes
- Spamming, phishing, or other fraudulent activities
- Reverse engineering, decompiling, or attempting to derive the source code of the Plugin
- Modifying, altering, or tampering with the Plugin code
- Attempting to circumvent usage limits or access controls
- Any commercial use beyond generating content for Your own WordPress website(s)
Content Responsibility
You are solely responsible for all content generated using our Service and for ensuring such content complies with all applicable laws and third-party rights.Intellectual Property Rights
Plugin Ownership
We retain all rights, title, and interest in and to the Plugin software, including all capabilities, features, and implementation. The Plugin is licensed via Paid Membership, not sold, to You.AI-Generated Content Ownership
You own the AI-generated content created through our Service. However, You are solely responsible for ensuring such content does not infringe upon third-party rights and complies with other restrictions imposed upon AI-generated content, such as, but not limited to, not representing the likeness of identifiable persons or plagiarizing in any way.Plugin Modifications
You are strictly prohibited from modifying, customizing, or altering the Plugin code in any way. Any such modifications will:- Void all support and warranties
- Release Us from any liability for consequences resulting from modifications
- May result in immediate Account termination
Reverse Engineering and Security
Reverse engineering the Plugin’s capabilities, features, or attempting to replicate our Service is strictly prohibited. Such activities will result in:- Immediate Account termination without refund
- Permanent blacklisting from our Service
- Potential legal action
Payment and Pricing
Subscription Fees
Paid Memberships require recurring payments as specified in Your chosen plan. All fees are non-refundable except as expressly stated in our Cancellation and Refund Policy.Price Changes
All membership fees and pricing for add-ons are subject to change at Our discretion. By maintaining a membership, You accept any price increases. We may or may not notify You of price changes via email.Payment Processing
Payments are processed by third-party payment processors. We do not store Your payment information.Service Availability and Changes
Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice, except for planned outages as described below.Planned Outages
We will will attempt to notify Members via email of planned service outages at least one (1) week prior to the scheduled outage.Service Dependencies
Our Service relies on third-party providers. Service interruptions may occur due to factors beyond Our control.Account Termination
Termination by You
You may cancel Your membership at any time through Your Account settings or by contacting us using our Contact Form.Termination by Us
We may terminate Your Account immediately and without refund under the following conditions:- Modification of Plugin code
- Attempts to reverse engineer or hack the Service
- Violation of acceptable use policies
- Non-payment of fees
- Any other material breach of these Terms
Violation Process
For policy violations (excluding payment issues and security breaches), We will:- Notify You via email of the violation
- Provide 24 hours for You to respond and rectify the violation
- If no adequate response is received, terminate Your Account without refund
- Reserve the right to blacklist You and pursue legal action based on violation severity
