Introduction

This Cancellation, Refund & Dispute Policy (“Policy”) governs the cancellation of memberships, refund procedures, and dispute resolution processes for 3Porter’s services (“Company”, “We”, “Us”, “Our”). This Policy should be read in conjunction with Our Terms of Service and Privacy Policy.

Definitions

For the purposes of this Policy:
  • Billing Period refers to the recurring payment cycle for Your membership (monthly or annual).
  • Free Trial refers to the 7-day complimentary access period.
  • Add-On Images refers to additional image generation credits purchased separately from membership plans.
  • Service refers to Our Website, Plugin, and related services.
  • You refers to the individual or entity using Our Service.

Cancellation Process

How to Cancel

You may cancel Your membership through the following methods:
  • Account Dashboard: Log into Your account at https://www.3porter.ai and click the “Cancel Membership” link from the left menu of Your account Dashboard
  • Contact Form: Submit a cancellation request using our Contact Form

Cancellation Effective Date

Membership cancellations become effective at the end of Your current billing period:
  • Free Trial: Effective at the end of the 7-day trial period
  • Monthly Memberships: Effective at the end of the current monthly billing cycle
  • Annual Memberships: Effective at the end of the 12-month billing cycle

Access After Cancellation

You will retain full access to Our Service until the cancellation effective date. After this date, Your access will be terminated and You will no longer be able to generate content using Our Plugin.

Refund Policy

No Refund Policy

We maintain a strict no-refund policy for all paid memberships and services. Because We provide a 7-day Free Trial that allows You to fully test all features of Our Plugin and Service before committing to a paid membership, no refunds will be provided under any circumstances, including but not limited to:
  • Dissatisfaction with the Service
  • Technical issues or compatibility problems
  • Service outages or downtime
  • Unused portions of Your membership
  • Partial billing periods
  • Changes in personal circumstances
  • Account termination for policy violations

Add-On Images Refund Policy

Add-on image purchases are non-refundable. Once purchased, add-on images cannot be returned, refunded or transferred to another account for any reason.

Add-On Images Upon Cancellation

Loss of Unused Add-On Images

When Your membership cancellation becomes effective, any unused add-on images will be forfeited and no longer available for use.

Restoration Upon Re-Subscription

If You sign up for a new paid membership using the same account in the future, any previously forfeited unused add-on images will be restored and made available for use again.

Service Availability and Technical Issues

No Guarantee of Availability

We do not guarantee 100% service availability or uptime. Service interruptions may occur due to maintenance, technical issues, third-party service outages, or other factors beyond Our control.

Service Outage Response

In the event of service outages:
  • AI generation requests are expected to automatically re-queue when service is restored
  • We may, at Our sole discretion, work with affected customers who have lost credits due to extended outages
  • No refunds will be provided for service interruptions

Compatibility Issues

We do not guarantee compatibility with all WordPress themes, plugins, hosting environments, or server configurations. Technical incompatibilities do not qualify for refunds.

Support Obligations

Before any request for accommodation due to technical issues, You must:
  • Contact Our support team through the Contact Form
  • Provide detailed information about the issue You are experiencing
  • Allow reasonable time for Our team to investigate and attempt resolution
  • Follow recommended troubleshooting steps provided by Our support team
Failure to engage with Our support process may result in denial of any accommodation requests.

Billing Disputes and Chargebacks

Billing Disputes

All billing is processed through Stripe, Our third-party payment processor. For billing disputes:
  • Contact Us first through our Contact Form to resolve the issue directly
  • If unresolved, You may dispute charges through Your credit card issuer or bank
  • We will work with Stripe and financial institutions to provide necessary documentation for dispute resolution

Chargeback Policy

Chargebacks will be handled in conjunction with Stripe and may result in immediate account suspension pending resolution. Frivolous or invalid chargebacks may result in permanent account termination and potential legal action.

Account Termination Refunds

Accounts terminated for violations of Our Terms of Service or other policies are not eligible for any refunds or accommodations.

Dispute Resolution

Governing Law

This Policy and any disputes arising from Your use of Our Service shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

Jurisdiction

Any legal action or proceeding arising under this Policy shall be brought exclusively in the federal or state courts located in Indiana, and You hereby consent to personal jurisdiction and venue therein.

Informal Resolution

Before initiating any formal legal proceedings, You agree to first attempt to resolve any dispute by contacting us through our Contact Form and providing Us with 30 days to address Your concerns.

Limitation on Legal Action

Any claim or cause of action arising out of or related to Your use of Our Service must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.

Individual Basis

Disputes must be brought on an individual basis and not as part of any class action, collective action, or representative proceeding.

Modifications to This Policy

We reserve the right to modify this Policy at any time. Changes will be effective immediately upon posting on Our Website. Your continued use of Our Service after any modifications constitutes acceptance of the revised Policy.

Grandfathering

Changes to this Policy will apply to all existing and future memberships, regardless of when the membership was purchased, unless otherwise specified.

Severability

If any provision of this Policy is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
